Terms & Conditions

These Terms & Conditions (“Terms”) are the agreement between you and Instant Health Services LLC (“InstantMD,” “we,” “us”) governing your use of our website, eligibility check, and telehealth platform. By using the services, you agree to these Terms, our Privacy Policy, and our Telehealth Consent.

The short version

The platform is ours; your medical care belongs to your licensed clinician. InstantMD is not for emergencies, and no treatment or prescription is ever guaranteed. The sections below spell out the details.

Section 1

Agreement to these Terms

By accessing or using InstantMD’s website, eligibility check, or telehealth platform, you agree to be bound by these Terms, our Privacy Policy, and our Telehealth Consent. If you do not agree, do not use the services.

Section 2

Who may use InstantMD

You must be at least 18, located in a state where our services are available, and able to enter a binding agreement. Program-related medical services are available to Medicare-enrolled patients who meet the applicable program’s criteria as determined by a licensed clinician.

Section 3

What we provide — and who provides it

InstantMD provides the technology platform: the eligibility check, scheduling, secure messaging, records, and billing automation. Medical care is provided by licensed clinicians through Metabolic Health Group of Florida, P.A., an independent medical practice. InstantMD does not practice medicine and does not interfere with the professional judgment of any clinician. Our website and messaging assistant provide general information and support; they do not provide medical advice, diagnosis, or treatment — only your clinician does that, through a visit.

Section 4

Not for emergencies

InstantMD is not for medical emergencies. If you are experiencing an emergency, call 911 or go to the nearest emergency room. Do not use the platform or messaging to report urgent symptoms.

Section 5

No guarantee of treatment or prescriptions

A visit is an evaluation, not a promised outcome. Whether any medication is prescribed, continued, or discontinued is a clinical decision made solely by your clinician based on your health and the applicable program’s criteria. Checking eligibility does not enroll you in any program and does not guarantee coverage, treatment, or a prescription.

Section 6

Your account & your information

You agree to provide accurate, current information — including your identity and Medicare coverage details — and to keep your login credentials secure. You are responsible for activity under your account. We may suspend accounts that provide false information or misuse the services.

Section 7

Costs, billing & Medicare

Program costs are set by the applicable Medicare program, not by InstantMD. Any amount you may owe out of pocket is shown to you before you book. Claims are submitted to Medicare and applicable payers on your behalf. InstantMD is not affiliated with or endorsed by Medicare, CMS, or any government agency. Program terms, criteria, and timelines are set by the program and may change.

Section 8

Communications & text messages

By providing your phone number, you consent to receive service-related text messages (such as appointment reminders and support conversations). Message frequency varies; message and data rates may apply; reply STOP to opt out and HELP for help. Opting out of texts does not affect your care, though some conveniences may be unavailable.

Section 9

Acceptable use

You agree not to misuse the services — including attempting to access others’ information, interfering with the platform’s operation, scraping, reverse engineering, or using the services for any unlawful purpose. We may suspend or terminate access for violations.

Section 10

Intellectual property

The platform, site, and their content (excluding your information) are owned by InstantMD or its licensors and protected by law. We grant you a limited, personal, non-transferable license to use the services as intended. “InstantMD” and our logos are our trademarks.

Section 11

Disclaimers & limitation of liability

Except as expressly stated, the services are provided “as is” and “as available.” We do not warrant that the services will be uninterrupted or error-free. Nothing in this section limits the professional obligations of clinicians to their patients.

Section 12

Dispute resolution & governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.

Section 13

Changes & contact

We may update these Terms as the services evolve. If changes are material, we will notify you (by posting, email, or in-platform notice) before they take effect. Continued use after the effective date means you accept the updated Terms.
